How matters have unfolded

The following are drawn from typical patterns in matters handled by the practice. Names and identifying details have been changed.

Challenge

Unmarried heirs, intestate estate, and agricultural land

The deceased left no will. There were four adult children with different views about the family land in Khon Kaen province. Two wanted to sell and divide the proceeds; two wished to retain the land. The conversation among siblings had become tense before the family came to the practice.

Solution

A review meeting was held first, with all four siblings present, to map out the estate and the applicable intestate succession provisions. This alone reduced some of the tension, as the family had been operating under different assumptions about their entitlements. The practice then facilitated a structured discussion, leading to an agreed arrangement that satisfied all four heirs without formal dispute proceedings.

Outcome

Challenge

Dispute resolved by negotiated agreement within 14 weeks. Distribution adjusted by mutual consent. No formal court proceedings were required. All three heirs received a closing report. Legal costs for the family as a whole were significantly lower than contested litigation would have produced.

Challenge

Solution
