Challenge

Unmarried heirs, intestate estate, and agricultural land

The deceased left no will. There were four adult children with different views about the family land in Khon Kaen province. Two wanted to sell and divide the proceeds; two wished to retain the land. The conversation among siblings had become tense before the family came to the practice.

This alone reduced some of the tension, as the family had been operating under different assumptions about their entitlements. Challenge

Contested will, out-of-province heir, and allegation of undue influence

One of three heirs filed a challenge to the validity of a will, alleging that the deceased had lacked capacity when it was executed. The challenging heir was based in Bangkok. The other two heirs were in Khon Kaen. The matter had the potential to become lengthy and expensive.

Solution

Nakhon Counsel reviewed the documentation carefully and advised that while the challenge had a factual basis that could not be dismissed, its prospects in court were uncertain for both sides. A negotiated resolution was proposed that acknowledged the challenger's concerns while allowing the estate to proceed on a modified distribution basis. All parties agreed to mediation.

Dispute resolved by negotiated agreement within 14 weeks. Distribution adjusted by mutual consent. No formal court proceedings were required. All three heirs received a closing report. Legal costs for the family as a whole were significantly lower than contested litigation would have produced.

Sole heir, complex estate, no experience of Thai legal procedure

A widow inherited her husband's estate as sole beneficiary under a valid will. The estate included a commercial property, two bank accounts, and a vehicle. She had never dealt with Thai legal or administrative processes before and was uncertain where to begin.

Solution

The review meeting produced a clear written map of what the estate comprised and what each element required procedurally. The practice then handled the court application for administrator appointment, liaised with both banks, coordinated the Land Department transfer for the commercial property, and managed the vehicle transfer process. The client was updated in writing after each significant step.

Outcome
